Acceptance of Terms

This website is owned and operated by Pilot Checks, LLC. By accessing or using this website and the scheduling services provided through it, you agree to be bound by the following Terms of Service (“Terms”). For purposes of these Terms, “Pilot Checks,” “we,” or “us” refers collectively to Pilot Checks, LLC and the FAA Designated Pilot Examiners (“DPEs”) represented on this website. If you do not agree with any part of these Terms, you should not use this website or the associated services.

Purpose of the Service

Pilot Checks, LLC provides an online platform for information and scheduling of FAA practical tests (checkrides) and related administrative services conducted by the DPEs it represents. The website serves as an organizational tool and a communication intermediary between pilot applicants and those DPEs. All practical test services scheduled through this site are to be conducted in accordance with applicable FAA regulations and guidance.

Please note that submitting a scheduling request through the website does not guarantee an appointment for an FAA practical test or service. Each request is subject to review and approval by the selected DPE on a case-by-case basis. Until a DPE explicitly confirms a date and time, no practical test is officially scheduled. The role of the website is limited to facilitating the scheduling and initial coordination; ultimate approval or denial of a requested appointment rests with the DPE.

Eligibility Requirements

By using the scheduling service, you represent that you meet all FAA eligibility requirements for the practical test or service you seek to schedule. This includes, without limitation, having completed the necessary training, endorsements, aeronautical experience, and documentation as required under the relevant FAA regulations (e.g., 14 CFR Part 61) for the certificate or rating in question. You are responsible for ensuring that all information you provide is truthful, accurate, and complete.

  • False or Incomplete Information: Providing false, misleading, or incomplete information, or failing to meet any FAA prerequisite or requirement (as outlined in 14 CFR and FAA guidance), may result in your scheduling request being rejected or an existing appointment being canceled. This includes, for example, failing to have the proper instructor endorsements, knowledge test results, or other documentation required by the FAA for your practical test.

  • Aircraft and Equipment: If your practical test requires an aircraft (e.g. flight exams), you must furnish a safe, airworthy, and appropriately equipped aircraft for the test. The aircraft must have all required documentation (logbooks, airworthiness certificate, etc.) and be in a condition for safe operation. Failure to provide a suitable aircraft will result in cancellation of the practical test appointment. Neither Pilot Checks, LLC nor the DPE is responsible for providing an aircraft. It is your responsibility to ensure the aircraft’s availability and readiness.

Fees and Payments

Examiner Fees: The fees for FAA practical tests (checkrides) or related services are set by the individual DPEs and will be communicated to you in advance. Unless otherwise agreed directly with the DPE, payment of the DPE’s fee is due in full immediately prior to the start of the practical test or administrative service. All such fees are paid directly to the DPE. This website itself does not process or collect payments on behalf of examiners – any payment transactions (whether made in person, via an external payment service, or other methods) are strictly between you and the DPE. For example, a DPE may require cash or a certified check at the appointment, or use a third-party payment processor, but in all cases Pilot Checks, LLC does not handle your payment details.

No Refunds for Services Rendered: Once a practical test or service has begun (i.e., the examination has started or the DPE has commenced the service), the examiner’s fee is generally non-refundable. If you discontinue the test or if the test results in a failure (disapproval) early in the process, you will not be entitled to a refund of the fee for the portion of the service that was conducted. Any exceptions or partial refunds in such scenarios are at the sole discretion of the DPE. If you have questions or disputes regarding fees or payments, you should address them with the DPE directly, as Pilot Checks, LLC is not a party to the payment transaction and cannot issue refunds on an examiner’s behalf.

Cancellations and Rescheduling

Cancellation by Applicant: If you need to cancel a scheduled practical test or service, you must do so at least 48 hours in advance of the appointment time. Cancellations made with short notice (less than 48 hours) or failure to appear for a scheduled appointment (a “no-show”) may result in penalties. The DPE may, at their discretion, charge a cancellation fee or require advance payment before accepting a new booking in the future, especially in cases of last-minute cancellation or no-show. Repeated late cancellations or no-shows can also result in the DPE (or Pilot Checks, LLC on the DPE’s behalf) declining to accept any future scheduling requests from you.

Rescheduling: All rescheduling of practical tests is subject to the DPE’s discretion and availability. We and the examiners will make a good-faith effort to accommodate rescheduling requests – particularly in cases where a practical test was ended in a Discontinuance (paused due to weather, mechanical issues, or other issues not resulting in failure) or a Disapproval (failure requiring a re-test). Applicants who receive a notice of discontinuance or disapproval will typically be given priority consideration for new dates, but rescheduling is not guaranteed. The ability to reschedule quickly will depend on the DPE’s schedule and other applicants in the queue. Please be aware that if a follow-up test cannot be scheduled within the timeframe allowed by the FAA for completion of a discontinued test (generally 60 days), you may be required by FAA rules to start a new practical test from the beginning. (FAA regulations generally require that any incomplete practical test be completed within 2 calendar months of the original test date, otherwise all portions of the test must be re-taken.) We are not responsible for any consequences if scheduling availability does not permit completion of a test within FAA timelines.

Cancellation by Examiner: In some cases, a DPE may need to cancel or reschedule an appointment (due to weather, aircraft issues, personal emergencies, or other factors). The DPE will inform you as soon as possible if they must cancel. Pilot Checks, LLC is not liable for any costs (such as travel or accommodation) you incur due to a cancellation by an examiner.

Applicant Conduct and Behavior

Professional and respectful behavior is expected at all times when using our services and during any scheduled practical test. This includes interactions through the website (such as communications with the examiner via email or phone) and in-person conduct on the day of the test. You agree to conduct yourself safely and courteously. Any of the following behaviors can result in immediate termination of your practical test or service, at the examiner’s discretion, without a refund:

  • Unsafe or Reckless Behavior: Any operation of an aircraft or simulators in an unsafe manner during the test, or any act that poses a risk to the examiner, yourself, or others. Safety is paramount; if the examiner observes a dangerous lack of airmanship or a violation of regulations that jeopardizes safety, the test will be halted.

  • Threatening or Abusive Conduct: Any form of threatening, abusive, or harassing behavior toward the examiner, staff, or others (whether verbal, physical, or written). You must treat the examiner and all personnel with respect.

  • Disruptive or Unprofessional Actions: This includes failure to follow the examiner’s instructions, persistent arguing or non-cooperation, arriving under the influence of alcohol or drugs, or any other conduct that the examiner deems wildly inappropriate or disruptive to the testing process.

If a test is terminated due to misconduct or rule violations, the examiner will file the appropriate documentation (e.g., an immediate disapproval for the test) and, if necessary, such behavior may be reported to the FAA and/or law enforcement authorities. Pilot Checks, LLC and the examiners reserve the right to refuse future service to individuals who have engaged in misconduct or have violated these standards of conduct.

Use of the Website and Account Security

(In addition to in-person conduct, you must use this website lawfully.) You agree not to misuse the Pilot Checks website. This means you will not attempt to gain unauthorized access to the site’s systems, not interfere with the normal operation of the site, and not use the site to transmit any malware or harmful code.

Privacy and Personal Data

Using our scheduling services will require you to provide personal information (including potentially sensitive personally identifiable information) and to upload certain documents. By using the site, you agree that Pilot Checks, LLC may collect, use, and disclose your information as described in the Privacy Policy We are committed to protecting your data in compliance with applicable laws and regulations, and we provide details of our data practices in the Privacy Policy. Do not upload any document or information unless you have the right to do so and understand that it will be shared with your selected examiner for the purpose of conducting the FAA test. For example, you may be asked to upload a copy of your photo ID, pilot certificates, or training records; this information will be used solely to verify eligibility and facilitate the test. By scheduling through this site, you consent to the collection and use of your data as outlined herein.

Limitation of Liability and Disclaimers

Use at Your Own Risk: Pilot Checks, LLC provides this website and scheduling service to help connect applicants with DPEs, but we cannot guarantee that every aspect of the process will meet your expectations. You assume all risk and responsibility for using this website and the services. To the maximum extent permitted by law, Pilot Checks, LLC, its owners, and the DPEs represented on this site shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the site or any services arranged through it. This includes (but is not limited to) any loss of profit, loss of opportunity, travel or accommodation costs, or other financial loss, as well as any loss of data or personal information, or claims of third parties. In no event will Pilot Checks, LLC or its represented examiners be liable for an amount exceeding the fees (if any) you paid for the scheduling service or the DPE’s fee for the practical test in question.

No Liability for Scheduling Outcomes: Pilot Checks, LLC and its DPEs are not responsible for costs or consequences of scheduling outcomes, such as a failed checkride (e.g., if you do not pass your practical test), the need to reschedule due to weather or other delays, or any delays caused by FAA administrative processes. We do not guarantee that an FAA practical test will ultimately occur on the date scheduled – unforeseen circumstances (weather, mechanical issues, air traffic delays, examiner availability, FAA actions, etc.) may intervene, and by using this service you acknowledge those possibilities. You agree that you will not hold Pilot Checks, LLC or the examiner liable for any expenses, such as aircraft rental costs, instructor fees, or travel expenses, arising from a cancellation or delay of your test. Always have contingency plans for scheduling changes.

Examiner Independence: Each DPE listed or scheduling through this website is an independent professional authorized by the FAA (not an employee of Pilot Checks, LLC). Pilot Checks, LLC acts as a booking and administrative agent, but it does not supervise or control the manner in which the DPE conducts the FAA practical test. All FAA practical tests are conducted strictly in accordance with FAA standards and the examiner’s FAA-issued authority. As such, the outcome of any practical test (whether you pass or fail) is solely determined by the DPE based on your performance and FAA regulations – Pilot Checks, LLC has no influence over that outcome and cannot overturn or change any test result. Furthermore, while we strive to list qualified and reputable examiners, we do not make any guarantees or warranties about the DPE’s suitability, training style, or disposition beyond the fact that they are currently authorized by the FAA.

No Warranties; “As Is” Service: This website and scheduling platform is provided on an “as is” and “as available” basis without any warranty of any kind, either express or implied. We specifically disclaim any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the website will be available at all times or without interruption, or that the information on the site (including examiner availability or any content provided) is accurate, complete, or up-to-date. While we make reasonable efforts to maintain the site, technical issues or errors may occur. You acknowledge that aviation activities inherently carry risks, and while the DPE will follow FAA safety standards, Pilot Checks, LLC does not assume liability for any accident, incident, property damage, personal injury, or death that may occur during or in connection with an FAA practical test or related activity. The DPE and applicant are expected to conduct the test in accordance with all safety regulations; any liability for incidents during the test will be determined by applicable law and FAA rules, not by these Terms.

Limitation on Damages: To the extent that any liability of Pilot Checks, LLC or the examiner is not otherwise excluded, and to the extent permitted by law, the maximum aggregate liability of Pilot Checks, LLC and the DPE to you for any claim arising from or related to the services or these Terms shall not exceed the total amount of fees you paid to the DPE or Pilot Checks (if any) for the specific service or test that gave rise to the claim. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you. However, in such cases, the liability of Pilot Checks, LLC and the examiners will be limited to the greatest extent permitted by law.

Indemnification

You agree to indemnify and hold harmless Pilot Checks, LLC, its owners, agents, employees, and the DPEs using this platform, from and against any and all claims, liabilities, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of or in any way connected with: (a) your access to or use of the website and services; (b) your violation of any of these Terms or of any applicable law or regulation; (c) your infringement of any rights of another person or entity (such as providing data or uploading content that you had no right to provide); or (d) any negligence, willful misconduct, or wrongful act by you in the course of scheduling or taking a practical test.

This means that if a third party (or governmental agency) makes a claim against Pilot Checks, LLC or an examiner due to your actions – for example, if you violate someone’s rights or cause damage and someone sues – then you will be responsible for any costs or damages that we incur as a result of your action. We will notify you in the event of any such claim or legal action, and you agree to cooperate with us in defending it. This indemnification obligation will survive the termination of these Terms and your use of the website.

Changes to Terms

Pilot Checks, LLC reserves the right to update or modify these Terms of Service at any time. If we make material changes, we will post the revised Terms on this website and update the “Effective Date” at the top. It is your responsibility to review the Terms periodically for updates. By continuing to use the website or the scheduling services after any changes to the Terms are posted, you accept and agree to be bound by the revised Terms. If you do not agree to the modified Terms, you must stop using the website and services.

Governing Law and Dispute Resolution

These Terms of Service and any disputes arising under them are governed by the laws of the State of Colorado, USA, without regard to its conflict of law principles. By using this site, you agree that if any disputes or legal actions do arise between you and Pilot Checks, LLC (or between you and a DPE in connection with our services), such disputes will be subject to the jurisdiction of the state and federal courts located in the State of Colorado. You consent to personal jurisdiction in Colorado courts and waive any objections based on inconvenient forum or jurisdiction for such disputes.

Note: Use of this site is intended for individuals in the United States. If you access or use the site from other jurisdictions, you are responsible for compliance with local laws, and you understand that any user disputes will be resolved under U.S. (Colorado) law.
